Trademark Law

A service mark is any word, name, symbol, device, or any combination, used, or intended to be used, in commerce, to identify and distinguish the services of one provider from services provided by others, and to indicate the source of the services.

Federal registration of a trade or service mark has several advantages, including notice to the public of the registrant's claim of ownership of the mark, a legal presumption of ownership nationwide, and the exclusive right to use the mark on or in connection with the goods or services set forth in the registration.

Domain Name Protection

Domain name disputes arise largely from allegations of cybersquatting, which involves the pre-emptive registration of trademarks by third parties as domain names. Cybersquatters exploit the first-come, first-served nature of the domain name registration system to register names of trademarks, famous people or businesses with which they have no connection.

Domain name disputes are often resolved through the Uniform Dispute Resolution Policy (UDRP), an administrative proceeding put in place by the Internet Corporation for Assigned Names and Numbers (ICANN) to govern trademark disputes over domain names. Administrative panels deciding matters pursuant to the UDRP evaluate three factors in determining whether a violation has occurred:

  • Whether the domain name is identical or confusingly similar to a trademark or service mark in which the complainant has rights.
  • Whether the respondent has any rights or legitimate interests in the domain name (for example, the legitimate offering of goods and services under the same name).
  • Whether the domain name was registered and is being used in bad faith.
